We would like to thank you for giving us the opportunity to provide your quote for your project. All quotes are valid for a period of 30 days from the date they are created. Quotes are determined by information provided by you the homeowner or builder (i.e. blueprints, sketches, drawings, email and/or verbal conversations) and are subject to change based on the accuracy of that information up to the date of the quote. Quotes are subject to change based on final, field-verified measurements of the job site.
Montgomery Woodwrights, Inc. (MWI) / Woodwright Cabinet Company proposes to supply and install the items listed on the quote as shown on the job drawings which shall be provided by us after acceptance of the quote. Upon issuance of the first set of shop drawings (Issued For Review or IFR), up to two revisions may be made prior to the job entering production, so long as the revisions do not represent a change in job scope.
Changes in job scope include, but are not limited to:
We understand that situations arise that require a change to an order, and we will gladly make any changes to your order as long as it has not entered production. After that, any changes to this project must be submitted in writing. Alterations involving extra costs will be made only upon written agreement, and will become an extra charge, over and above this contract. Any loss of materials, labor, or clerical work due to these changes after production has started will be the responsibility of the buyer.
We will make every effort to meet all scheduled milestones and installation dates. Delays due to backordered materials, shipment delays, delays caused by other tradesmen on the job site, delays caused by weather or other unforeseen circumstances are not considered a breach of contract and may require altering the schedule. If the items listed on the quote are complete and ready for delivery or install, and the job site is not ready for the installation or delivery, we reserve the right to charge storage fees not to exceed $250 per week unless alternative arrangements can be made.
We propose to perform all work in accordance with the drawings and specifications submitted, and completed in a workman like manner according to best practices and standard methods of the trade.
Customer agrees to pay invoices based on the following schedule:
PROJECTS LESS THAN $25,000
PROJECTS OVER $25,000
For the purpose of this agreement, substantial completion is defined as the point after which all cabinetry has been delivered or installed and is able to be used for its intended purpose. For minor items such as door adjustments, handle installation, or punch list items, we may, at our discretion, provide a holdback on the final invoice, not to exceed $5,000. Only one punch list will be accepted.
A 1.5% finance charge will be assessed weekly on any unpaid balance. If contractor and/or owner fail to make payments as specified below, owner shall be responsible for any and all legal and collection fees necessary for the collection of the balance due.
The contract may be terminated by Montgomery Woodwrights, Inc. / Woodwright Cabinet Company in whole or in part at any time, in the best interest of the company, for cause such as failure of the buyer to timely pay, insistence by buyer on modifications to the scope of a project that has already been placed into production without an agreement to pay the increased costs associated with such modifications, etc.
Work performed milestones as a percentage of the overall project are defined as below:
Any Amendment or modification of this Agreement or any additional obligation assumed by Montgomery Woodwrights, Inc in connection with this agreement, shall only be binding if evidenced in writing by each party or an authorized representative of each party.
The parties hereby agree that there is no representation, warranty, collateral agreement or condition affecting this Agreement except as expressly provided in this Agreement.
This agreement shall be governed in accordance with the laws of the State of Texas.
In the event that any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, all other provisions shall nevertheless continue to be valid and enforceable with the invalid or unenforceable provisions severed from the remainder of this Agreement.
We warrant our products for life against defects in material and workmanship as defined and specified by our limited warranty guidelines which are available upon request. Warranty will not be valid if terms of this contract are not met, or defects are the result of anything other than normal wear-and-tear. Owner agrees to unconditionally guarantee the payment of the order for the total listed on the quote and any additional orders to the same address. Owner acknowledges that the contractor is purchasing this product and they are the owners of the real property listed on the proposal.
All proposals and quotes may be withdrawn by our company at any time before acceptance.
